Tornado Cash Co-founder Asks Court to Dismiss Charges

Attorneys representing Roman Storm, the co-founder of cryptomixer Tornado Cash, have filed a motion seeking to dismiss the charges against him, which include conspiracy to commit money laundering, operating without a license, and violating IEEPA.

The defense team also cited the First Amendment to the US Constitution, arguing that writing code constitutes an exercise of freedom of speech.

“This prosecution attempts to criminalize software development, a right protected by the First Amendment. There is no evidence to suggest that Storm conspired with individuals who later misused the software for illegal activities,” the document states.

Furthermore, the defense highlighted that Storm cannot be held liable for the actions of users who utilized the cryptomixer. They emphasized that users retained control of their assets and did not pay any commission to Tornado Cash.
